ATLAS CONSUMER PROMOTION -2024: “ATLAS TREASURE HUNT – PHASE 2” TERMS AND CONDITIONS

 

  1. These Terms and Conditions relate to the “Atlas Treasure Hunt – Phase 2” Consumer Promotion. Information on the manner of entry as well as the Prize forms part of these Terms and Conditions, and hence Entry to the Promotion is deemed to be acceptance of these Terms and Conditions.

 

  1. The Promoter is Atlas Axillia Company (Private) Limited, a company duly incorporated under the Sri Lankan Companies Act, No. 07 of 2007 having Company Number PV7125 and having its registered office at “ 96, Parakrama Road, Old Kandy Rd, Peliyagoda 11830” (“Promoter”).

 

  1. The Competition is carried out by the Promoter for the purpose of promoting the Atlas Products whereby a maximum of Three Hundred and Fifty (350) lucky consumers shall be eligible to win a Mountain Bicycle and Sixty (60) consumers shall be eligible to win a family pack with Three Tickets (03) to Pearl Bay Amusement Park, Bandaragama, totalling the value of the Prizes awarded to Rupees Twenty-Two Million Nine Hundred and Forty-Six Thousand (LKR. 22,946,000/-). The Competition is subject to the Terms and Conditions set forth herein.
  2. Definitions
    1. “Competition” shall mean the competition carried out by the Promoter for the purpose of promoting the Products, whereby the consumers shall purchase Atlas Products in accordance with the procedure set out in Clause 5 below to win the Prize as set out in Clause 7.
    2. “Channel” shall mean to the two distinct Channels through which the Promotion shall be executed, specifically delineated as follows;
      1. Channel 1 – Encompasses Three Hundred and Fifty (350) General Trade Outlets, where the Promotion will take place from 10th May 2024 to 31st July 2024 as “Bicycle for Rs.500”.
      2. Channel 2 – Comprises Cargills Food City and Keells Outlets, where the Promotion will be held from 1st June 2024 to 31st August 2024.

    4. “Entry” shall mean entering into the Competition in the manner set out in Clause
    5. “Family members” shall mean spouse, ex-spouse, parent, step-parent, grandparent, uncle, aunt, niece, nephew, natural or adopted child, and sibling or step-sibling (whether natural or adopted by a parent) of a person, whether or not they live in the same household.
    6. “General Trade Outlet” shall mean small scale retail stores other than supermarkets and chain stores, where Entry Coupons will be issued and the Promotion is carried out.
    7. “Independent Auditor” shall have the same meaning as stipulated in Clause
    8. “Intellectual Property” shall mean trade-marks, service marks, trade names, domain names, logos, get-up, patents, inventions, registered and unregistered design rights, copyrights, semi-conductor
      1. topography rights, database rights and all other similar rights in any part of the world including, where such rights are obtained or enhanced by registration, any registration of such rights and applications and rights to apply for such registrations.
    9. “Participant” shall mean the purchaser of the Products who enters the
    10. Promoter” shall mean Atlas Axillia Company (Private)
    11. Promotion” shall mean “Atlas Treasure Hunt – Phase 2” consumer promotion carried out by the
    12. “Promotional Period” shall mean the period during which the promotion shall be carried out, commencing on the 10th of May 2024 until the 31st of August 2024.
    13. “Products” shall mean any “Atlas Products”, including but not limited to B5 Books, Children’s Books, CR Books, Drawing Books, Exercise Books, Notepads & Books, Other Paper Products, Practical Books, Science Books, Spiral Books, Colour Pencils, Colour Pens, Crayons, Highlighters, Markers, Pastels, Poster Colours, Water Colours, Lunch Boxes, Water Bottles, Calculators, Copy Papers, Files, Glue, Markers, Punchers, Staplers, Stapler Pin Packs, White Ink, Pens, Clay, Erasers, Mathematical Boxes, Pencils, Rulers, Scissors, Sharpeners, Sporting Items, and Tissues, in any size, volume, or page count. All size variants of these products are eligible for the competition.
    14. “Prize” shall mean either an Atlas branded Mountain Bicycle or a Pearl Bay Amusement Park Family pack with Three Tickets (03), in the manner set out in clause 7 herein.
    15. “Winner”: shall mean the person selected by the Promoter as a result of participating in this Competition, though a random selection process as set out in Clause 7.
    16. Unless the context otherwise requires, words in the singular shall include the plural and vice
    17. References to Clauses are to the Clauses of these Terms and
    18. Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
    19. “Terms and Conditions” shall mean the terms and conditions contained
  3. Manner of Entry
    1. Consumers can take part in the Promotion as follows:

Upon purchase of Atlas Products worth Rupees Five Hundred (LKR 500), from a selected General Trade Outlet under Channel 1, or Rupees One Thousand (LKR 1,000) from a Cargills Food City or Keells Outlet, under Channel 2, a participant will receive a coupon. The participant must complete the coupon with their personal details, including their name and contact number, and then submit it to the designated drop box at the outlet to qualify as an entry (“Entry”) into the competition.
    3. The purchase of Atlas Products may consist of any combination of Atlas products on a single bill, as long as the total meets or exceeds the minimum required purchase amount.
    4. Each purchase of Atlas Products totalling Rupees Five Hundred (LKR 500) from a Channel 1, General Trade Outlet or Rupees One Thousand (LKR 1,000) from a Channel 2, Cargills Food City/ Keells Outlet entitles the participant to one coupon. Additional coupons will be awarded for every increment of Rupees Five Hundred (LKR 500) or Rupees One Thousand (LKR 1,000), respectively, within a single

  4. Conditions of Entry
    1. This Competition is open to all citizens residing in Sri Lanka, except for the employees and Family members of the Employees of the Promoter, its associate companies, advertising and promotional agencies and its auditors connected to the Promotion.
    2. The Promotion is conducted through Three Hundred and Fifty (350) selected General Trade Outlets under Channel 1 and Cargills Food City or Keells Outlets under Channel 2 and participants shall be qualified to take part in the Competition only upon purchase of the Products from such outlets during the Promotional Period set out herein.
    3. The Promotion will be closed for participation after the 31st of July 2024 for Channel 1 and after 31st of August for Channel 2 and no person shall, under any circumstances, shall be eligible to participate in the Promotion and win Prizes after the Promotional Period.
    4. This Promotion holds validity exclusively upon the purchase of the Products. Every purchase of the mentioned Products, in accordance with the details outlined in Clause 5, will inherently qualify as a valid Entry.
    5. It is the responsibility of the Participants to ensure that they complete the mandatory fields of the coupon and submit a valid Entry, within the stipulated guidelines and time period, as stated herein and the Promoter shall not be held responsible for an incomplete or late An incomplete or late Entry shall be considered as an invalid Entry.
    6. The Promoter makes the final determination as to which Entries are eligible to take part in the Competition and no correspondence and/or appeals will be entertained in this regard.

  5. Prizes
    1. The Winner selection shall be carried out as follows;
    2. Channel 1 – One (01) winner will be selected via a raffle draw from each of the General Trade Outlets within two weeks subsequent to the end date of the Promotion. A total of Three Hundred and Fifty (350) Winners will be selected and each winner shall be entitled to receive One (01) Mountain Bicycle.
    3. Channel 2 – Sixty (60) winners will be selected from all the entries received through a raffle draw within two weeks after the Promotion’s end date. Each winner will be entitled to receive one (01) gift pack containing three (03) tickets to Pearl Bay Amusement Park.
    4. The Prize will be handed over directly to the Winners by the Promoter and the Winners will be required to sign receipts upon acceptance of the Prize. Upon acceptance of the Prize, the risk and title of the Prize shall pass to the Winner.
    5. The Winners, when contacted, shall provide necessary details to the Promoter and/or its Agents, to verify the authenticity of their eligibility for the Prize.
    6. All Prizes shall be provided to the Winner at no additional cost on part of the Winner, but any other expenses including but not limited to meals, taxes, transport, insurance and any other ancillary/personal costs of any nature shall be borne by the Winner.
    7. The Prizes covered by this Promotion are not assignable and are non-transferrable and shall not be exchanged or substituted for cash.
    8. The Promoter shall not accept any liability and makes no warranties or representation in relation to the Prizes and all warranties or conditions implied by law (including, without limitation, implied terms relating to the quality of the Prizes and fitness for a particular purpose), are, to the extent permitted by law, hereby expressly excluded.

  6. Judging Criteria for the Raffle Draw
    1. The Winner selection raffle draws will be held within two weeks subsequent to the end date of the Promotion, with winners for Channel 1 selected separately through individual draws at each of the General Trade Outlets. For Channel 2, winners will be chosen from a single draw conducted from the collective pool of all received entries. The draws will take place in the presence of an Independent Auditor, and the Promoter’s decision shall be final.
    2. All winners will be contacted on or before 15th September If the Winner is not able to be contacted within the period, that Winner shall forfeit the Prize and the Promoter may choose to abandon the said draw or to draw another Winner, and so on until a Winner is contacted to accept the Prize.
    3. A Participant is entitled to only one winning chance
    4. The Winners, when contacted during the Raffle Draw Announcement, shall provide necessary details (including information to verify the identity of the Winner) such as phone number, NIC number, and
    5. residential address, to the Promoter and/or its Agents, in order for the Promoter to provide the Winner with the relevant Prize.
    6. The Promoter shall not be liable for any loss of Prize due to incorrect address, contact details, NIC details etc., or insufficiency or inaccuracy of any information provided by the Winner.
  7. Independent Auditors
    1. Winners will be selected under the supervision and direction of the officials of the Revenue Department of Western Provincial Council.

  9. Miscellaneous
    1. The Promoter’s decision on the verification of all the Participants shall be final and no correspondence will be entered into in relation to any decision taken by the Promoter.
    2. Winners agree that the Promoter has the sole right to decide on all matters and disputes arising from the Promotion and/or the Competition and that all decisions of the Promoter are final and binding on all parties.
    3. The Promoter may disqualify any Entry or Participant (including any Prize Winner) who tampers with the Entry process, submits an Entry not in accordance with the Terms and Conditions, or who has, in the opinion of the Promoter, engaged in conduct which is unlawful, improper, fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter or Promotion and/or
    4. The Promoter assumes no responsibility, for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of Entries.
    5. The Promoter reserves the right to cancel, modify, extend or withdraw the Promotion and/or Competition at any time and at its sole and absolute discretion.
    6. If for any reason the Promotion is not capable of running as planned for reasons including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, natural disasters, postal strikes or any other cause beyond the control of the Promoter, which corrupt or affect the
    7. administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to cancel, suspend or modify the Promotion.
    8. The Promoter assumes no responsibility, and accepts no liability, whether jointly or severally, for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, unauthorized access to, or alteration of Entries.
    9. By submitting an Entry, each Participant further warrants and represents that his/her Entry complies with all conditions stated in these Terms and Conditions, and agrees that the Promoter and its agents will bear no legal liability to the Participant or any third parties regarding the use of the Entry by the Promoter and its agents, and that the Promoter’s and its agents shall be indemnified and held harmless by Participant in the event it is subsequently discovered that the Participant has not fully complied with any of the Terms and Conditions set forth herein.
    10. The Promoter shall not be held responsible (to compensate (or otherwise)) for any loss, expense, injury or any other liability, whether direct, indirect, consequential, and foreseeable, due to some negligent act, omission or otherwise, arising out of the Promotion or due to participation, Entry and/or acceptance of a Prize by any person associated with this Promotion/Competition. The Participants shall indemnify and hold the Promoter and its ‘Agents’ (which shall include Employees of the Promoter, its respective successors, affiliates, officers, directors, subsidiaries, representatives, agents, and other vendor agencies, Prize dealers, advertising, promotion agencies and third parties facilitating the Competition) harmless from and against any and all claims, losses, and/or damages, liens, judgments, penalties, attorneys’ and consultants’ fees, expenses and/or liabilities arising out of, involving, or in connection therewith.
    11. These Terms and Conditions shall be governed by the applicable laws of Sri All disputes relating to these Terms and Conditions, the Promotion and/or the Competition shall be subject to the exclusive jurisdiction of Courts at Colombo, Sri Lanka.
    12. The Promoter and its agents does not make any representation or warranty (expressed or implied) as to the completeness and accuracy of any advertising and/or publicity material pertaining to the Competition and the customer/consumer shall be solely responsible for its own assessment and evaluation of any such advertising and/or publicity material.
    13. The Promoter shall not be held responsible and/or liable for any action taken by the customer/consumer in reliance of any advertising and/or publicity material pertaining to the

A consumer inquiry hotline (077 211 1333) dedicated to the Competition will be in operation from the commencement of the Promotional Period until the 15th September Consumers are encouraged via advertisements to contact the hotline, to obtain more clarity on the Promotion’s terms (if required). The Promoter shall not be held accountable for any verbal information dispensed from any other hotline number, claiming to be the Promoter and/or associated with the Promotion and/or Competition.
    15. The Competition/Promotion is subject solely to these Terms and Conditions. These Terms and Conditions may be translated into two (2) other languages, Sinhala and Tamil. In the event of any inconsistency between the English, Sinhala and Tamil texts of these Terms and Conditions, the English text of these Terms and Conditions shall prevail.
    16. By submitting an Entry, each Participant grants consent to publish their name, address, and photograph in any media if they win this competition.
